THIS AMENDMENT was concluded this 6th day of March 2008,
BETWEEN: HER MAJESTY THE QUEEN IN RIGHT OF CANADA, hereinafter referred to as "Canada," represented by the Minister of Canadian Heritage and Status of Women,
AND: THE CORPORATION OF THE COUNCIL OF MINISTERS OF EDUCATION, CANADA, hereinafter referred to as "the Corporation," represented by the President, of the Corporation of the Council of Ministers of Education, Canada.
THIS AMENDMENT ATTESTSthat, in consideration of the mutual covenants herein, the parties agree to amend the Agreement signed March 29, 2007, as follows:
Clauses 3.1 and 3.2 of the Agreement are deleted and replaced with the following:
2006-07 - $7,451,812 (The full amount of Canada’s contribution, as identified in the protocol, totals to $9,491,000; however the CCMEC acknowledges a difference of $2,039,188, which is attributable to the changing of the fiscal year.)
2007-08 - $10,166,464 (The full amount of Canada’s contribution, as identified in the protocol, totals to $10,391,000; however the CCMEC acknowledges the difference of $224,536, which is attributable to the variance between the fiscal year and the school year.)
2008-09 - $10,391,000
Subject to the Agreement between Canada and the Corporation, the amounts below are transfers from provinces and territories in accordance with subsection 6.4.2 of the Protocol:
2006-07 - $944,980
2007-08 - $967,420
2008-09 - $967,420
The yearly total contributions to the programs will be as follows:
2006-07 - $8,396,792
2007-08 - $11,133,884
2008-09 - $11,358,420
Transfers by provinces and territories in accordance with subsection 6.4.2 of the Protocol and any additional special sum could be added to this maximum amount (see Schedule 3 for annual adjustments).
3.2 Canada’s total contribution includes any amounts the provincial and territorial governments may transfer to these programs under section 2.2 of Schedule 1 of this Agreement.
All other clauses contained in the Agreement remain unchanged, and in the event of any inconsistencies, the provisions of the current Amendment take precedence over those of the original Agreement signed on March 29, 2007.
IN WITNESS WHEREOF, the parties have signed this Amendment to the Agreement.
